Mock Court highlights psychological social risk and why it matters for education leaders

icare, the NSW Government’s insurance and care provider, along with the NSW Department of Communities and Justice (DJC) and Safe TM, recently hosted a mock court at UTS on 20 November to demonstrate the serious consequences of failing to manage psychosocial risks in the workplace. We were proud to be the only claims service provider invited to attend by icare. This invitation is recognition of our strong track record of stepping forward for programs, pilots, and initiatives that improve outcomes for injured workers and those who support them.

As the largest claims service provider for the NSW Treasury Managed Fund (TMF), we manage around 85% of the education portfolio in NSW, giving us deep insight into the challenges faced by schools, universities, and education staff. Our participation reflects our commitment to sharing knowledge that helps education leaders create safer, healthier workplaces.

The mock court placed senior leaders in a simulated prosecution scenario presented over 3 stages over 2.5 hours, highlighting the legal and reputational risks of failing to address psychosocial hazards. These hazards, such as bullying, harassment, occupational violence, and aggression, aren’t abstract concepts for the education sector. Teachers and staff may face harassment from colleagues, dismissal disputes, or even aggression from students. These situations can escalate quickly, impacting mental health and exposing organisations to litigation.

The event reinforced that compliance alone isn’t enough. Organisations must take proactive steps to design safer work environments, clarify roles, and provide support systems that reduce psychosocial risk. Doing so helps prevent mental health injuries, reduces absenteeism, and fosters a culture of care.

The University of Sydney and Sydney Catholic Schools were among the attendees and highlighted that the event provided an excellent opportunity for education sector partners. The experience offered a deeper understanding of the legal process and reinforced the importance of early intervention. This type of experiential learning serves as a powerful catalyst for change, prompting leaders to pause and consider how they can improve.

At Allianz, we believe that initiatives like this Mock Court are essential for driving meaningful improvements in workplace safety. By partnering with icare and engaging in these programs, we aim to share insights that help education leaders protect staff wellbeing and meet their legal obligations.

Bullying, harassment, and occupational violence can lead to prosecution and reputational damage. Prevention is not optional. It’s a legal and ethical responsibility.

Addressing issues before they escalate reduces harm to staff and minimises organisational exposure. Clear reporting channels and support systems are critical.

It’s not enough to expect staff to cope better with stressors. Leaders must design safer work environments, clarify roles, and foster a culture of care.
